Terms and Conditions

Minimum Age: You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use this App. By using the App, you represent and warrant that you meet this age requirement.

Age Attestation: Registration requires you to confirm your date of birth. We do not independently verify age; you represent and warrant that the date of birth you provide is accurate. If we receive a credible report or signal that a user is under 18, we will suspend the account pending review and delete it on confirmation.

Content Warning:The App facilitates the exchange of "wish cards" which may include explicit sexual language and themes. By using the App, you consent to viewing and creating such content within the confines of your couple relationship.

Mutual Consent Required:Both partners must independently accept an invitation and agree to form a "couple" within the App. Content is only shared between confirmed, mutually-consenting partners.

Partner Invitation: When you invite a partner, they receive an email and/or push notification with your name and email address. They must actively accept the invitation to join your couple.

Withdrawing Consent / Reset Couple: Either partner may dissolve the couple relationship at any time using the "Reset Couple" feature in the App. Upon dissolution: (i) the couple becomes inactive and any in-flight quest is cancelled; (ii) shared quest progress is archived; (iii) if either partner's in-app access was granted via the other partner's subscription, that access ends immediately upon reset. Each user may invite a new partner after reset, but you will only retain in-app access if you hold an active subscription of your own.

Reporting Abuse: If you experience harassment, abuse, or any form of misconduct from a partner, you may report it through the "Report Abuse" feature in the App or by contacting us at support@blushquest.com. We take all reports seriously and will investigate promptly.

Authentication: We use Better-Auth for one-time-password (OTP) authentication via email. You are responsible for maintaining the security of your email account and for all activities that occur under your account.

Profile Accuracy: You agree to provide accurate, current, and complete information during registration (Name, Gender, Date of Birth) and to update such information as necessary.

One Account Per Person: You may only create and maintain one account. Creating multiple accounts to harass, deceive, or circumvent restrictions is strictly prohibited and may result in permanent ban.

Account Security: You must immediately notify us at support@blushquest.com if you suspect unauthorized access to your account.

Ownership:You retain ownership of the text and content you input into "wish cards." However, you grant BlushQuest a limited, non-exclusive license to store, transmit, and display this content solely for the purpose of providing the App's functionality to you and your partner.

Responsibility: You are solely responsible for the content you create and send to your partner. BlushQuest does not review, moderate, or endorse user-generated wish cards.

Prohibited Content: You may not use BlushQuest to share:

• Content depicting or promoting non-consensual sexual acts.
• Content involving minors in any sexual context.
• Illegal acts, solicitation, or content that violates applicable laws.
• Hate speech, threats, harassment, or abusive language.
• Content that infringes on third-party intellectual property rights.
• Spam, malware, or malicious content.

Local Laws: In certain jurisdictions (e.g., UAE, Indonesia), the transmission of explicit materials may be restricted by law. You agree to comply with all applicable local regulations when using the App.

Mutual, Freely-Given Consent: Any activity suggested by, derived from, or inspired by a wish card must be agreed to freely and unambiguously by both adult partners before, during, and throughout participation. Consent may be withdrawn at any time, for any reason, without explanation.

Legality in Your Jurisdiction: Laws governing sexual conduct, expression, and intimate activity vary significantly by country, state, province, and locality. You are solely responsible for ensuring that every activity you propose, accept, or perform in connection with the App is lawful where you and your partner are located.

Right to Decline, Modify, or Skip: Either partner may decline, modify, postpone, or skip any wish card at any time, for any reason, without consequence within the App. Skipping a card does not break a streak in a way that penalizes the relationship; it is a normal, expected part of using BlushQuest. Pressuring a partner to complete a card they have declined is itself a violation of these Terms.

No Coercion or Manipulation:You must not use the App — or any wish card, badge, streak, level, notification, or in-app feature — to coerce, pressure, manipulate, guilt, deceive, threaten, or otherwise non-consensually involve a partner in any activity they have not freely agreed to.

Safety and Harm-Reduction: Before beginning a quest, we strongly encourage you and your partner to discuss your boundaries, limits, comfort levels, and (if relevant) a safe word. If a wish card describes an activity that carries physical risk, you are responsible for educating yourselves on appropriate safety practices and for declining anything you are not equipped to do safely.

Prohibited Content and Activities: In addition to the categories listed above, you may not create, send, request, or act on any wish card that involves, depicts, promotes, facilitates, or solicits:

• Any sexual, romantic, or intimate content involving a person under the age of 18 (or the age of majority in their jurisdiction, whichever is higher). This includes real, fictional, simulated, computer-generated, or AI-generated depictions. There are no exceptions.
• Non-consensual sexual acts, sexual coercion, sexual assault, or any depiction or roleplay that glorifies or normalizes the absence of consent.
• Physical violence, torture, weapons, mutilation, or activities likely to cause serious bodily injury — excluding consensual, informed, harm-reduction-aware kink between adults that complies with all applicable laws.
• Any activity that is illegal in your jurisdiction, including but not limited to commercial sex work where prohibited, exchange of money or goods for sexual acts, or use of controlled substances.
• Bestiality, necrophilia, or any other content prohibited by applicable obscenity laws.
• Hate speech, threats, harassment, slurs, or content that targets a person or group based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
• Self-harm, suicide ideation, eating disorders, or content that promotes, encourages, or instructs dangerous practices.
• Doxing, sharing of a third party's personal information without consent, revenge content, or non-consensual intimate imagery.
• Spam, phishing, malware, scams, fraud, or content that infringes any third party's intellectual property, privacy, or other rights.

Your Sole Responsibility: BlushQuest does not pre-screen, moderate, vet, endorse, prescribe, or guarantee the safety, legality, health, or appropriateness of any wish card or any activity it describes. Wish cards authored by you, by your partner, or drawn from our library are prompts — not recommendations. You and your partner are solely responsible for deciding whether, when, how, and to what extent to act on any wish card, and for any and all consequences of doing so.

"As Is" and "As Available":THE APP, INCLUDING ALL WISH CARDS, QUEST CONTENT, SUGGESTIONS, AND ANY AI-GENERATED OR ALGORITHMICALLY SURFACED MATERIAL, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLUSHQUEST DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

Entertainment, Not Therapy: BlushQuest is an adult entertainment and relationship-enrichment product. It is not medical advice, psychological advice, sex therapy, couples counseling, legal advice, or any other form of professional service, and it is not a substitute for consultation with a qualified physician, licensed therapist, certified sex educator, attorney, or other appropriate professional. No therapist-patient, counselor-client, or attorney-client relationship is created by your use of the App.

Conversation Starters, Not Prescriptions: Wish cards — whether drawn from BlushQuest's library, generated by partner input, or surfaced by any AI or algorithmic system — are creative prompts intended to spark conversation and play between consenting partners. They are not prescriptions, instructions, recommendations, or endorsements of any specific act. BlushQuest makes no representation that any wish card is safe, healthy, lawful, ethical, age-appropriate, medically advisable, or otherwise suitable for you or your partner.

No Pre-Moderation of Partner-Authored Content: BlushQuest functions as a conduit for content authored by you and your partner. We do not pre-screen, review, edit, or moderate user-authored wish cards before delivery. We may review content after the fact in response to a credible abuse report (see Section 3) or where required by law, but we have no obligation to monitor user content and assume no responsibility for it.

Assumption of Risk:You acknowledge and agree that any decision to act on a wish card — or to invite, permit, or participate in any activity described, suggested, or inspired by the App — is made entirely at your own risk and the risk of your partner. You assume full responsibility for all physical, emotional, psychological, relational, financial, and legal consequences arising from any such activity.

Consult a Professional Before Acting: If you have any medical condition, mental-health concern, history of trauma, relational difficulty, or legal question that could be affected by a suggested activity, you should consult an appropriately qualified professional before acting on the suggestion. If you or your partner experience distress, anxiety, conflict, or non-emergency mental-health concerns connected to use of the App, BlushQuest recommends consulting a licensed therapist or counselor in your jurisdiction.

Discuss Limits Before You Begin: We strongly encourage you and your partner to talk openly about boundaries, comfort levels, soft and hard limits, and (where relevant) safe words and aftercare practices before starting any quest. BlushQuest provides tools to skip, decline, or end any card or quest; we expect you to use them.

Service Availability: We do not guarantee that the App will be available at all times, uninterrupted, secure, or error-free, nor that defects will be corrected. We may modify, suspend, or discontinue any aspect of the App at any time without notice.

BlushQuest Ownership: The App, including its design, branding, logos, curated wish card content, graphics, user interface, and underlying technology, is owned by BlushQuest and protected by intellectual property laws. All rights not expressly granted herein are reserved.

Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use during an active subscription or trial period.

Restrictions: You may not:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse engineer, decompile, or disassemble the App.
• Attempt to extract source code or underlying algorithms.
• Use automated tools (bots, scrapers) to access the App.
• Remove or alter any proprietary notices or labels.
• Use the BlushQuest name, logo, or branding without written permission.

Subscription name: BlushQuest Premium.

Tiers and pricing: Prices are listed below in U.S. dollars. The App Store and Google Play convert these to your local currency using their own regional pricing, so the amount you are actually charged may differ from a direct conversion of the USD figures and may include applicable taxes. The price shown in the app at the point of purchase is the price that applies to you.

• Monthly — $16.90 per month, renews every 1 month.
• 6-Month — $83.90 per six months (approximately $13.98/month), renews every 6 months. New subscribers to the 6-Month plan receive a 7-day free trial.
• Yearly — $118.99 per year (approximately $9.92/month), renews every 12 months. New subscribers to the Yearly plan receive a 14-day free trial.

Length: Each subscription lasts for the period stated above and renews automatically for the same period at the same rate unless cancelled.

Free trial: New subscribers to the Yearly plan receive 14 days of free access, and new subscribers to the 6-Month plan receive 7 days of free access. If you do not cancel at least 24 hours before the end of the trial, your account will be charged the price of the plan you selected. Any unused portion of the free trial is forfeited if you purchase a non-trial subscription before the trial ends.

Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase and, for renewals, within 24 hours prior to the end of the current period.

Auto-renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price as the initial subscription unless we have notified you of a price change.

Manage / cancel: You can manage your subscription and turn off auto-renewal in your Apple ID or Google Play account settings after purchase. Cancelling in the app does not by itself cancel the App Store or Google Play subscription. Cancellation takes effect at the end of the current billing period; you retain access until then.

Restore purchases:If you reinstall the App or sign in on a new device with the same Apple ID or Google Play account, you can restore your subscription via the "Restore Purchases" option in the paywall screen.

Refunds: Refund requests are handled by Apple (apple.com/legal/itunes/us/sales.html) and Google (support.google.com/googleplay/answer/2479637) according to their respective refund policies. BlushQuest does not directly process refunds for store-billed subscriptions, and no refunds are provided for partial billing periods. If you are a consumer resident in the European Union or United Kingdom, you may have a statutory right to withdraw from the purchase within 14 days of confirmation. To exercise this right, contact support@blushquest.com. By starting use of the subscription (e.g., sending a quest invitation) during this 14-day period, you expressly request immediate provision of the service and acknowledge that you will lose the right of withdrawal once the service has been fully performed.

Couple coverage ("sender-pays"):A single active subscription held by either member of a confirmed couple grants in-app access to both members for the lifetime of that couple. If the subscribing partner cancels their subscription, ends the couple (see "Reset Couple", Section 3 above), or has their account terminated, the non-subscribing partner will also lose access until they either subscribe themselves or form a new couple with another subscriber. You acknowledge that subscription status is tied to the subscribing partner's account, not to your account.

Functional legal links: Links to these Terms and to our Privacy Policyare available within the subscription purchase screen and at any time in the app's Settings → Legal menu.

Apple App Store and Google Play Store rules apply. Your subscription is also subject to (i) the Apple Media Services Terms of Use if you purchase via the App Store, or (ii) the Google Play Terms of Service if you purchase via Google Play. In the event of any conflict between those store terms and these Terms regarding the mechanics of billing, renewal, refunds, or cancellation, the applicable store terms will control as to that subject.

Third-Party Offers: Discounts and rewards are provided by third-party partners and are subject to their availability, terms, and conditions. BlushQuest is not responsible for the fulfillment, quality, or availability of third-party offers.

No Guarantee: We do not guarantee the availability, value, or redemption of any offers. Partners may change or discontinue offers at any time without notice.

Geographic Limitations: Some offers may be limited to specific regions or countries.

Program Changes: BlushQuest reserves the right to modify, suspend, or discontinue the Super Cards program at any time.

By You: You may delete your account at any time from your Profile screen in the App (Profile → Delete account), or by request to dpo@blushquest.com / the page at /legal/delete-account. Upon deletion, any active couple is dissolved and your data is deleted in accordance with our Privacy Policy. Deleting your account does not by itself cancel an App Store or Google Play subscription — you must cancel that separately in your store settings.

By BlushQuest: We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms or any applicable laws.
• Engage in fraud, abuse, or harassment.
• Create prohibited content.
• Attempt to compromise App security or integrity.
• Are reported for abuse and investigation confirms misconduct.

Effect of Termination: Upon termination, your right to use the App ceases immediately. We may delete your data as outlined in our Privacy Policy. Termination does not entitle you to a refund of subscription fees already paid.

Cap on Aggregate Liability:TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF BLUSHQUEST, ITS FOUNDERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES (COLLECTIVELY, THE "BLUSHQUEST PARTIES"), ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL OR EQUITABLE THEORY — SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT YOU PAID TO BLUSHQUEST FOR SUBSCRIPTION FEES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Exclusion of Certain Damages: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE BLUSHQUEST PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR ANTICIPATED SAVINGS, EVEN IF BLUSHQUEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Specifically Excluded Categories: Without limiting the generality of the foregoing, the BlushQuest Parties shall have no liability for, and you expressly release the BlushQuest Parties from, any claim arising out of or relating to:

• Any emotional, psychological, physical, sexual, relational, reputational, financial, or other harm allegedly resulting from your or your partner's decision to act on, decline, modify, or otherwise respond to any wish card or quest.
• Loss of consortium, loss of affection, alienation of affection, loss of relationship, separation, divorce, breakup, or any other harm to the relationship between you and your partner.
• The acts, omissions, statements, or representations of your partner or any other user, including any allegation of coercion, manipulation, non-consent, deception, abuse, harassment, assault, or other misconduct.
• Any decision, action, or inaction that you or your partner take in reliance on a wish card, quest content, AI-generated suggestion, or any other content surfaced by the App.
• Disclosure of intimate content, account information, or activity to a third party as a result of your or your partner's sharing, screenshotting, forwarding, device-sharing practices, or loss of device.
• Failure to comply with Section 5.6 (Acceptable Use), Section 6 (Disclaimers and No Professional Advice), or any applicable law in your jurisdiction.
• Acts of God, natural disasters, war, terrorism, pandemics, government action, civil unrest, internet or telecommunications failures, power outages, third-party service-provider failures, or any other force-majeure event.

Essential Basis of the Bargain: You agree that the limitations and exclusions in this Section 11 are a material and essential basis of the bargain between you and BlushQuest, and that they apply even if any limited remedy is found to have failed of its essential purpose.

Jurisdictional Limits: Some jurisdictions do not permit the exclusion or limitation of certain warranties or damages (for example, incidental or consequential damages, or liability for gross negligence or willful misconduct). In those jurisdictions, the exclusions and limitations in this Section 11 apply only to the maximum extent permitted by applicable law, and nothing in these Terms is intended to limit any liability that cannot lawfully be limited.

Service Availability: We do not guarantee that the App will be available at all times, uninterrupted, or error-free. We may modify, suspend, or discontinue the App at any time without notice.

13.1 Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

13.2 Informal Resolution: Before filing any claim, you agree to first send a written notice describing the dispute to legal@blushquest.com and to negotiate in good faith for at least 30 days.

13.3 Binding Arbitration: Any dispute arising out of or relating to these Terms or the App that is not resolved informally shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, with the seat of arbitration in Wilmington, Delaware. The arbitrator shall apply Delaware law. The arbitration will be conducted in English and may be conducted by videoconference. BlushQuest will pay the JAMS filing fee for claims under $10,000.

13.4 Class-Action Waiver: YOU AND BLUSHQUEST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

13.5 30-Day Right to Opt Out: You may opt out of this arbitration agreement by sending written notice to legal@blushquest.com within 30 days of first accepting these Terms. Opting out will not affect any other provision of these Terms.

13.6 Small-Claims Carve-Out: Either party may bring an individual action in small-claims court if the dispute qualifies.

13.7 Injunctive Relief: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.

13.8 Non-U.S. Users: If you are resident outside the United States, mandatory consumer-protection laws of your country of residence may override the choice of Delaware law where required by those laws.
