Terms and Conditions

Minimum Age: You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use this App. By using the App, you represent and warrant that you meet this age requirement.

Age Verification: We collect your date of birth during registration to verify eligibility. If we discover that a user is under 18, we will immediately terminate their account and delete their data.

Content Warning: The App facilitates the exchange of "wish cards" which may include explicit sexual language and themes. By using the App, you consent to viewing and creating such content within the confines of your couple relationship.

Mutual Consent Required: Both partners must independently accept an invitation and agree to form a "couple" within the App. Content is only shared between confirmed, mutually-consenting partners.

Partner Invitation: When you invite a partner, they receive an email and/or push notification with your name and email address. They must actively accept the invitation to join your couple.

Withdrawing Consent: Either partner may dissolve the couple relationship at any time by using the "Reset Couple" feature in the App. Upon dissolution, the couple becomes inactive, shared quest progress is archived, and both users may invite new partners.

Reporting Abuse: If you experience harassment, abuse, or any form of misconduct from a partner, you may report it through the "Report Abuse" feature in the App or by contacting us at support@blushquest.com. We take all reports seriously and will investigate promptly.

Authentication: We use Supabase for OTP (One-Time Password) authentication via email. You are responsible for maintaining the security of your email account and for all activities that occur under your account.

Profile Accuracy: You agree to provide accurate, current, and complete information during registration (Name, Gender, Date of Birth) and to update such information as necessary.

One Account Per Person: You may only create and maintain one account. Creating multiple accounts to harass, deceive, or circumvent restrictions is strictly prohibited and may result in permanent ban.

Account Security: You must immediately notify us at support@blushquest.com if you suspect unauthorized access to your account.

Ownership: You retain ownership of the text and content you input into "wish cards." However, you grant BlushQuest a limited, non-exclusive license to store, transmit, and display this content solely for the purpose of providing the App's functionality to you and your partner.

Responsibility: You are solely responsible for the content you create and send to your partner. BlushQuest does not review, moderate, or endorse user-generated wish cards.

Prohibited Content: You may not use BlushQuest to share:

• Content depicting or promoting non-consensual sexual acts.
• Content involving minors in any sexual context.
• Illegal acts, solicitation, or content that violates applicable laws.
• Hate speech, threats, harassment, or abusive language.
• Content that infringes on third-party intellectual property rights.
• Spam, malware, or malicious content.

Local Laws: In certain jurisdictions (e.g., UAE, Indonesia), the transmission of explicit materials may be restricted by law. You agree to comply with all applicable local regulations when using the App.

BlushQuest Ownership: The App, including its design, branding, logos, curated wish card content, graphics, user interface, and underlying technology, is owned by BlushQuest and protected by intellectual property laws. All rights not expressly granted herein are reserved.

Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use during an active subscription or trial period.

Restrictions: You may not:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse engineer, decompile, or disassemble the App.
• Attempt to extract source code or underlying algorithms.
• Use automated tools (bots, scrapers) to access the App.
• Remove or alter any proprietary notices or labels.
• Use the BlushQuest name, logo, or branding without written permission.

Free Trial: New users receive a 7-day free trial with full access to App features. The trial automatically converts to a paid subscription unless cancelled before the trial period ends.

Billing: Subscriptions are processed via Apple App Store or Google Play Store. Payment is charged to your app store account upon confirmation of purchase or at the end of the trial period.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Renewal charges are processed at the same rate as the initial subscription.

Cancellation: You may cancel your subscription at any time through your device's app store subscription settings. Cancellation takes effect at the end of the current billing period; you retain access until then.

Refunds: Refunds are handled by Apple or Google according to their respective refund policies. BlushQuest does not process refunds directly. No refunds are provided for partial billing periods.

Third-Party Offers: Discounts and rewards are provided by third-party partners and are subject to their availability, terms, and conditions. BlushQuest is not responsible for the fulfillment, quality, or availability of third-party offers.

No Guarantee: We do not guarantee the availability, value, or redemption of any offers. Partners may change or discontinue offers at any time without notice.

Geographic Limitations: Some offers may be limited to specific regions or countries.

Program Changes: BlushQuest reserves the right to modify, suspend, or discontinue the Super Cards program at any time.

By You: You may terminate your account at any time through the App's Settings menu. Upon termination, your subscription (if any) will not renew, and your data will be deleted in accordance with our Privacy Policy.

By BlushQuest: We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms or any applicable laws.
• Engage in fraud, abuse, or harassment.
• Create prohibited content.
• Attempt to compromise App security or integrity.
• Are reported for abuse and investigation confirms misconduct.

Effect of Termination: Upon termination, your right to use the App ceases immediately. We may delete your data as outlined in our Privacy Policy. Termination does not entitle you to a refund of subscription fees already paid.

"As Is" Provision: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Relationship Advice: BlushQuest is a gamification tool for relationships. We do not provide medical, psychological, therapeutic, or relationship counseling services. We are not responsible for the outcome of any interactions or the health of your relationship.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUSHQUEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Service Availability: We do not guarantee that the App will be available at all times or that it will be error-free. We may modify, suspend, or discontinue the App at any time without notice.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE), without regard to its conflict of law provisions.

Informal Resolution: Before initiating any formal dispute resolution, you agree to first contact us at legal@blushquest.com and attempt to resolve the dispute informally for at least 30 days.

Arbitration: If the dispute cannot be resolved informally, you and BlushQuest agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the App through binding arbitration administered by the Dubai International Arbitration Centre (DIAC) in accordance with its rules. The arbitration shall be conducted in English in Dubai, UAE. The arbitrator's decision shall be final and binding.

Class Action Waiver: YOU AND BLUSHQUEST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.
